1. Definitions

• “Application” refers to the Interpark platform, including the website and mobile application.
• “User(s)” includes individuals, real estate agents, brokers, buyers, sellers, landlords, and tenants who access or use the application.
• “Content” includes property listings, user profiles, images, videos, and other data shared or uploaded by users.

2. Acceptance of Terms

By accessing or using the application, you agree to be bound by these terms and conditions, our privacy policy, and all applicable laws, including local regulations in Kenya and international standards.

3. User Obligations

1. Account Security:
   Users must safeguard their login credentials and notify Interpark immediately in case of unauthorized access.
2. Compliance:
   Users are required to comply with all applicable laws and regulations, including the Kenyan Land Act, Land Registration Act, Computer Misuse and Cybercrimes Act, and international property laws if operating outside Kenya.
3. Accuracy of Information:
   Users agree to provide accurate, up-to-date, and lawful information in all property listings and transactions.

4. Prohibited Activities

Users are prohibited from:

• Uploading false, fraudulent, or misleading property details.
• Using the application for money laundering, terrorism financing, or other illicit activities.
• Circumventing the platform to avoid fees or commissions.

5. Data Privacy and Security

1. Data Collection:
   Personal and transactional data will be collected and processed in accordance with the Data Protection Act of Kenya (2019) and GDPR for international users.
2. Encryption and Security Measures:
   Interpark uses advanced encryption and security protocols to safeguard data. Users agree to access the application over secure networks only.
3. Third-Party Data Sharing:
   Personal data will not be shared with third parties without consent, except for legal obligations or fraud prevention.

6. Liability and Disclaimers

1. Platform Liability:
   Interpark provides a platform for real estate interactions but is not responsible for the actual transactions or disputes between users.
2. User Liability:
   Users agree to indemnify Interpark against claims, losses, or damages arising from their actions or breaches of these terms.
3. No Guarantees:
   Interpark does not guarantee the accuracy, availability, or reliability of listings or other content on the platform.

7. Intellectual Property

1. Ownership:
   All application content, trademarks, and designs are the intellectual property of Interpark and protected under Kenyan and international copyright laws.
2. User Content:
   Users grant Interpark a royalty-free, non-exclusive license to use content uploaded to the platform for promotional purposes.

8. Dispute Resolution

1. Jurisdiction:
   Any disputes arising from these terms shall be governed by the laws of Kenya or, where applicable, international conventions.
2. Resolution Mechanism:
   • Local disputes will be resolved under Kenyan arbitration law.
   • International disputes may be handled via International Chamber of Commerce (ICC) arbitration rules.

9. Termination of Services

Interpark reserves the right to terminate user accounts for violations of these terms or misuse of the platform without prior notice.

10. Updates to Terms

These terms may be updated periodically. Users will be notified of significant changes and are responsible for reviewing the updated terms before continuing to use the application.
